These Terms and Conditions ("Terms") govern your use of the H&H Academy website (hnhacademy.com.au), the Practice Portal, and your enrolment in courses delivered by H&H ACADEMY PTY LTD ("H&H Academy", "we", "us", "our"). By accessing our website, submitting an enquiry, or enrolling in a program, you agree to these Terms. If you do not agree, you must not use our services.
1. About H&H Academy
H&H ACADEMY PTY LTD is a proprietary company registered in Australia, established in 2021 and operating as an English language education provider from Level 2, 22-28 Edgeworth David Avenue, Hornsby NSW 2077, Australia. Contact: Phone 02 7989 0749, Email info@hnhacademy.com.au.
2. Definitions
- Learner — an individual who enrols in or attends a H&H Academy program;
- Program — any structured course or coaching service we offer, including PTE Coaching, IELTS Preparation, OET Training, and General English;
- Portal — the H&H Academy Practice Portal and associated online learning resources;
- Enrolment Agreement — program-specific documentation (including fee schedules and study plans) provided at or before enrolment, which supplements these Terms.
If there is any inconsistency between these Terms and a signed Enrolment Agreement, the Enrolment Agreement prevails to the extent of the inconsistency.
3. Website use
You may use our website for lawful purposes only. You must not:
- attempt unauthorised access to our systems, the Portal, or other users' accounts;
- introduce malware, scrape content at scale, or interfere with site operation;
- misrepresent your identity or affiliation;
- copy, redistribute, or commercially exploit our materials except as expressly permitted;
- use the website in any way that violates applicable Australian law.
We may suspend or terminate website or Portal access for conduct that breaches these Terms or threatens the security or integrity of our services.
4. Enquiries and consultations
Information on our website and provided during consultations is general in nature. It does not constitute immigration advice, legal advice, or a guarantee of exam results, visa outcomes, or professional registration. Learners are responsible for verifying requirements with relevant authorities (e.g. Department of Home Affairs, AHPRA, assessing bodies).
Consultations and diagnostic activities are designed to assess fit and recommend study pathways. Participation does not oblige either party to proceed to enrolment.
5. Enrolment
Enrolment is confirmed when:
- you accept a written study plan or Enrolment Agreement;
- any required fees or deposits are paid in accordance with the payment schedule; and
- we confirm your place in writing (email or enrolment letter).
You must provide accurate personal and contact information at enrolment and notify us promptly of changes. False or misleading information may result in cancellation of enrolment without refund where permitted by law.
Learners under 18 years of age require parental or guardian consent documented at enrolment.
6. Fees and payment
Program fees are specified in the Enrolment Agreement or current fee schedule. Unless otherwise stated:
- fees are quoted in Australian dollars (AUD) and include GST where applicable;
- payment due dates must be met to maintain active enrolment and Portal access;
- late payment may result in suspension of classes and Portal access until the account is current;
- we accept payment methods as advised at enrolment (e.g. bank transfer, card payment via secure processor).
Fee adjustments for future intakes may occur. Changes do not affect fees already paid for an active enrolment period unless agreed in writing.
7. Cancellation, withdrawal, and refunds
Cancellation and refund rights are governed by the Australian Consumer Law (ACL) and any cooling-off or refund policy specified in your Enrolment Agreement. In summary:
- Cooling-off — where a cooling-off period applies under the ACL or your agreement, you may cancel within the stated period and receive a refund in accordance with that policy, less any permitted deductions for services already delivered;
- Withdrawal by learner — if you withdraw after the cooling-off period, refunds (if any) are calculated per the Enrolment Agreement based on unused tuition and administrative costs already incurred;
- Cancellation by H&H Academy — we may cancel a program due to insufficient enrolment, facilitator unavailability, or force majeure. In such cases, you will receive a full refund of fees paid for undelivered services or be offered transfer to another intake;
- Consumer guarantees — nothing in these Terms excludes non-excludable rights under the ACL. Services must be provided with due care and skill and be fit for the disclosed purpose.
Refund requests must be submitted in writing to info@hnhacademy.com.au. Processing times are typically 14–21 business days after approval.
8. Attendance, conduct, and academic integrity
Learners are expected to attend scheduled sessions (in person or online), complete assigned work, and engage respectfully with staff and other learners. Disruptive, discriminatory, or harassing behaviour may result in removal from a class without refund of fees for the affected period.
Academic integrity is mandatory. Plagiarism, impersonation in assessments, sharing of live exam content, or misuse of Portal materials undermines the learning process and may result in immediate suspension or termination of enrolment. We report suspected credential fraud to relevant authorities where required.
9. Practice Portal and intellectual property
Portal access is granted for personal study use during your enrolment period. All course materials, mock tests, videos, documents, and software on the website and Portal are owned by or licensed to H&H Academy and protected by Australian copyright law.
You must not reproduce, distribute, sublicense, or publicly display Portal content except as expressly allowed for your own study. Sharing login credentials is prohibited. Portal access may be revoked upon enrolment end, non-payment, or breach of these Terms.
10. Intellectual property of course materials
All course materials supplied by H&H Academy — including lesson plans, handouts, mock assessments, audio and video recordings, Practice Portal content, slide decks, and proprietary frameworks for writing and speaking tasks — remain the intellectual property of H&H ACADEMY PTY LTD or its licensors. Enrolment grants you a personal, non-transferable, revocable licence to access and use these materials solely for your own study during the active enrolment period.
You must not copy, photograph, screen-record, upload, share, sell, or redistribute course materials to third parties, including social media groups, file-sharing platforms, or other learners. Reverse-engineering portal content, removing copyright notices, or using materials to operate competing coaching services is prohibited. Breach may result in immediate suspension of Portal access, termination of enrolment without refund for the affected period, and pursuit of remedies available under Australian copyright law.
11. Online delivery
Where programs are delivered online, you are responsible for suitable internet connectivity, hardware, and a quiet study environment. We are not liable for service interruptions caused by your equipment, third-party platforms, or events outside our reasonable control. We will endeavour to reschedule sessions affected by technical failures on our side.
Recorded sessions, where provided, are for personal review only and may not be shared. Live session participation may be subject to attendance requirements specified in your Enrolment Agreement.
12. Limitation of liability
To the maximum extent permitted by law:
- we do not guarantee specific exam scores, visa grants, or employment outcomes;
- our liability for breach of a non-excludable consumer guarantee is limited, at our option, to resupply of services or refund of fees for the affected component;
- we are not liable for indirect, consequential, or special loss (including lost income or migration opportunity), except where liability cannot be excluded under the ACL or other applicable law.
13. Privacy
We collect and handle personal information as described in our Privacy Policy. By enrolling, you consent to the collection and use of your information for education administration, communication, and compliance purposes.
14. Complaints and disputes
We take complaints seriously. If you have a concern about our services, fees, or conduct, contact info@hnhacademy.com.au with a clear description of the issue. We will acknowledge your complaint and work toward resolution within a reasonable timeframe.
Our internal complaints process involves: (1) acknowledgement within seven business days; (2) investigation by a staff member not directly involved in the matter; (3) a written response with outcome and any remedial action; (4) escalation to senior management if you remain dissatisfied. If a dispute cannot be resolved directly, you may refer the matter to an appropriate external body — such as NSW Fair Trading for consumer matters — or seek independent legal advice. Nothing in this clause limits your rights under the ACL.
15. Force majeure
We are not in breach of these Terms if failure or delay results from events beyond our reasonable control, including natural disasters, pandemic restrictions, government orders, power failures, or critical infrastructure outages. We will use reasonable efforts to resume services and communicate alternative arrangements.
16. Changes to Terms
We may amend these Terms by publishing an updated version on our website. Changes apply to new enrolments from the effective date. Material changes affecting active enrolments will be communicated directly where practicable. Continued use of the website after publication constitutes acceptance of updated Terms for website use.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
